(Yuba-Sutter, CA) – The Third District Court of Appeals is now on board for a re-sentencing hearing, in the gross vehicular manslaughter and hit-and-run case of Constance Addison. The former Yuba City resident, now incarcerated, was found guilty in the death of 13-year-old Alex Flores as he walked to school along Franklin Avenue in Yuba City, 4 years ago. She was sentenced to 15 years to life.
The focus on the resentencing comes after the passing of Senate Bill 567. However, Sutter County District Attorney Jennifer Dupre tells The Appeal-Democrat ‘it will ultimately have no impact” on that (15 to life) sentence. The bill only became effective in January of last year, and it requires courts impose the ‘middle term of imprisonment…unless there are aggravating circumstances…” – As Addison’s 15 year sentence also includes a consecutive sentence of 4 years, which may be ‘subject in this case…due to four years being the upper term imposed’ according to the paper.
